Acceptance of Terms

By using www.firstjobinsports.com (the “Site”), You agree to be bound by these Terms & Conditions and the terms of any written agreements between You and First Job in Sports. In addition, there may be additional terms posted during the use of particular services provided through the Site, including, but not limited to, the First Job in Sports Privacy Policy. All such terms are incorporated by reference into these Terms & Conditions. Any features or services that are added to the Site from time to time shall also be subject to these Terms & Conditions.

If You do not accept these Terms & Conditions or do not meet or comply with their provisions, You may not use this Site.

We reserve the right to change our Terms & Conditions at any time. In the event of any changes, we will post the new Terms & Conditions here. Please check back periodically to review any changes.

Eligibility

You must be at least 18 years of age to use this Site. By using the Site, You represent and warrant that You are 18 years of age or older and that You have the right, authority and capacity to agree to and abide by these Terms & Conditions. You also represent and warrant to First Job in Sports that You will use the Site in a manner consistent with any and all applicable laws and regulations.

 

General Use

The Site may be used only for lawful purposes by individuals seeking internships or entry level jobs in the sports industry, and by employers or recruiters seeking candidates for internships or entry level jobs in the sports industry. First Job in Sports is under no obligation to monitor material posted on the Site, but it reserves the right to review resumes, job postings or other content submitted to the Site. Material found to violate these Terms & Conditions may be removed at First Job in Sports’ sole discretion.

You are solely responsible for maintaining the confidentiality of Your information and any account you create with First Job in Sports. You agree to notify First Job in Sports immediately of any unauthorized use of Your account.

 

License to Use

(a) For users who seek Employment: Subject to Your payment of the required account fee, First Job in Sports hereby grants to You a limited, terminable, non-exclusive right to access and use the Site only for seeking employment opportunities for Yourself. You agree that You are solely responsible for the content of any material You post to this Site, including Your resume, and any consequences arising from such posting. Resume postings must contain the accurate resume of a living individual seeking employment in an internship or entry level sports position on his or her own behalf. You represent and warrant that such data is accurate and current and that You are authorized to provide such data to First Job in Sports. First Job in Sports reserves the right to suspend or terminate Your use for any reason at any time, without refund, in its sole discretion.

(b) For users who are employers: First Job in Sports hereby grants to You a limited, terminable, non-exclusive right to access and use the Site only for Your internal business use seeking candidates for employment. You agree that You are solely responsible for the content of any material You post to the Site, including job openings, and any consequences arising from such postings. Job postings must be individual openings for internships or entry level positions (requiring three (3) or less years of experience) in the sports industry. First Job in Sports reserves the right to review any proposed job postings and decline to post such job openings at its sole discretion. You represent and warrant that such data is accurate and current and that You are authorized to provide such data to First Job in Sports. First Job in Sports reserves the right to suspend or terminate Your use for any reason at any time, without refund, in its sole discretion.

 

Posting Requirements and Restrictions

(a) License to First Job in Sports. By posting materials to any area of the Site, You grant First Job in Sports and its affiliates the royalty-free, perpetual, irrevocable, sublicenseable, non-exclusive right and license to use, reproduce, modify, distribute, perform and display that material worldwide and/or to incorporate it in other works in any form, media, or technology now known or later devised, for the full term of any rights that may exist in such content.

(b) Posting Requirements. Anything You post to the Site must contain sufficient detail to convey clearly and accurately the nature and requirements of the job opportunity, or Your qualifications as a candidate for employment.

(c) Restrictions on Postings. You may not post anything to the Site which contains (i) URLs or website links; (ii) material that infringes on or misappropriates any intellectual property rights, or violates the privacy or publicity rights of others; (iii) anything that is sexually explicit, obscene, libelous, defamatory, threatening, harassing, abusive, or hateful; or (iv) anything that is embarrassing or offensive to another person or entity. You may not post materials that (i) impersonate another person; (ii) include false, inaccurate or misleading information; or (iii) advertise or solicit business.

 

Intellectual Property

All Site design, text, graphics, logos, icons, the selection and arrangement of these elements, and all software are the property of First Job in Sports or its content suppliers and are protected by U.S. and international intellectual property laws, including copyright. The content and software on this Site is to be used solely for providing information and services to users of this Site. Any other use, including reproduction, modification, distribution, transmission, republication, display or performance of the content or software on this Site is strictly prohibited. First Job in Sports respects the intellectual property of others, and we ask our users to do the same.

 

Hyperlinks

You may create a hyperlink to the home page of www.firstjobinsports.com so long as it does not portray First Job in Sports, its affiliates, or its products and services in a false, misleading, or offensive manner. First Job in Sports may require that You remove a hyperlink at any time for any or no reason. You may use the First Job in Sports logo or other proprietary marks as part of the hyperlink only if you first obtain First Job in Sports’ express written permission.

First Job in Sports reserves the right to modify, suspend, delay or discontinue, temporarily or permanently, this Site (or any part thereof) or any of its products or services, with or without notice. Nothing on the Site shall be considered an endorsement, representation or warranty with respect to any user or third party. First Job in Sports makes no representations or guarantees regarding the effectiveness or timeliness of the Site in meeting the employment objectives of users. First Job in Sports is not responsible for any employment decisions made by any user.

First Job in Sports may, but is not obligated to, monitor the content and use of this website. In the event First Job in Sports receives notice that You have allegedly violated these Terms & Conditions, First Job in Sports may investigate such violation and consider it a breach of these Terms & Conditions. General Terms

These Terms & Conditions and all other terms or agreements referenced herein constitute the entire agreement between You and First Job in Sports with regard to Your use of the Site, and govern Your use of this Site, unless You and First Job in Sports have executed another express written agreement. Any additional express written agreement between You and First Job in Sports applies only to the extent there is a conflict between these Terms & Conditions and that other agreement. The failure of First Job in Sports to exercise or enforce any right or provision of these Terms & Conditions shall not constitute a waiver of such right or provision. If any provision of these Terms & Conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of these Terms & Conditions remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of this Site or these Terms & Conditions must be filed within one (1) year after such claim or cause of action arose or be forever barred.
